Terms and conditions

§1 Validity towards entrepreneurs and definitions of terms
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
(2) "Consumer" in the sense of these terms and conditions is any natural person who concludes a legal transaction for a purpose that cannot be attributed to his commercial or independent professional activity.

§2 Conclusion of a contract, storage of the contract text

(3) The presentation of the goods in our internet shop does not constitute a legally binding offer of contract on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our internet shop, the following regulations apply: The consumer makes a binding offer to conclude a contract by successfully completing the ordering procedure provided in our Internet shop.

The order is placed in the following steps:

a) Login in the Internet shop after registration and entering the login details (name, address, e-mail address and password).
b) Selection of the desired goods.
c) Checking the information in the shopping cart.
d) Pressing the button "Checkout".
e) Selection of the shipping method.
f) Selecting the payment method.
g) Accepting the general terms and conditions of business and delivery.
h) Reviewing or correcting the respective data entered.
i) Binding dispatch of the order.

Before the binding sending of the order, the consumer can return to the website where the customer's details are recorded and input errors are corrected or the ordering process is cancelled by closing the Internet browser by pressing the "Back" button in the Internet browser used by the consumer after checking his details. First, the consumer receives a confirmation of the receipt of his order by e-mail to the e-mail address provided by him (order confirmation). However, a sales contract is only concluded when our order confirmation is sent to the consumer by e-mail or when the ordered goods are delivered.
(5) Storage of the contract text for orders placed via our Internet shop: We save the text of the contract and send you the order data and our terms and conditions by e-mail. You can also view the AGB at any time at https://vwkaefershop.de/agb. You can view your past orders in our customer area under My account --> View my orders.

§3 Prices
The prices listed in this shop are valid when ordering via internet. All prices quoted include the value added tax (= sales tax) valid at the time of the order. All offers are subject to change. Our written order confirmation is required for the effective conclusion of the contract. This is replaced by delivery and/or invoicing.

If you make use of your right of revocation, you have to bear the regular costs of the return shipment (see revocation instruction).

§4 Payment, due date
We offer you the following payment options:

(1) Prepayment
Select "Prepayment" and the order is completed. You will then receive an order confirmation, which you can print out directly from your browser. At the same time you will receive an order confirmation to the email address you entered. You pay by bank transfer. On the day after the payment order has been given to the transferring bank, your order will be processed.
(2) Paypal
You pay the invoice amount via the online provider Paypal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. You must be registered there or register first, authenticate with your access data and confirm the payment order to us (exception: guest access if applicable). You will receive further information during the ordering process.
(3) PayPal Plus
With the help of the payment provider PayPal Plus we offer you the payment methods direct debit, credit card and purchase on account. When paying by direct debit, credit card or purchase on account, the purchase price claim is assigned to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
(4) Direct debit (via PayPal Plus)
After selecting PayPal Plus and direct debit, you will be redirected to the website of the payment provider PayPal. There you enter the data of your bank account. The amount will then be debited from your account. The order will be noted immediately as paid. You do not need a PayPal account for this process.
(5) Credit card (via PayPal Plus)
After selecting PayPal Plus and credit card, you will be redirected to the website of the payment provider PayPal. There you enter your credit card details. Your credit card will then be charged accordingly. The order will be noted immediately as paid. You do not need a PayPal account for this process.
(6) Purchase on account (via PayPal Plus)
After selecting PayPal Plus and purchasing on account, you will be redirected to the website of the payment provider PayPal. There you enter your billing data. You pay the invoice amount within a period of 10 days by bank transfer. The order will be noted immediately as paid. You do not need a PayPal account for this process.
(7) SOFORT bank transfer
When paying by instant bank transfer, you can initiate payment for the ordered goods via your online banking account while you are still placing your order. After selecting the payment method Sofortüberweisung in the order process you will be directed to the secure payment form of SOFORT GmbH, Fußbergstraße 1, 82131 Gauting. SOFORT GmbH automatically takes over the payment process, which is comparable to an EC card payment with PIN. Here we have no possibility to view the payment process or the data you entered. As with an EC card payment, SOFORT GmbH checks the credit limit of your account and makes a transfer to us if the account has sufficient funds. In addition, the system of SOFORT GmbH checks in about 30 percent of the cases whether previous payments were booked with Sofortüberweisung in order to exclude systematic fraud.
To make an immediate transfer, SOFORT GmbH needs your name, bank code, account number, PIN and a TAN of your online banking account. Only your name, bank code, account number, reason for transfer, amount and date of transfer are stored, not the credit limit or balance of your account or past transactions.
In case of a successful transaction we only receive an automated confirmation in real time from SOFORT GmbH that the transfer has been executed. The order will be noted immediately as paid.

There are no additional costs or fees for any of the payment methods indicated.

§5 Delivery
The delivery time within Germany is a maximum of 4 working days, provided that the goods are in stock and no other delivery time is indicated on the article detail page. The delivery times for other countries can be found in our information about delivery times. The delivery period begins, in case of payment in advance, on the day after the payment order is given to the transferring bank or, in case of other payment methods, on the day after the conclusion of the contract and ends with the expiry of the last day of the period. If the last day of the period falls on a Saturday, Sunday or a general holiday recognised by the state at the place of delivery, the next working day shall take the place of such day. Please understand that we cannot accept any liability for delays in delivery. In this case, our obligation to pay compensation is limited to taking back goods delivered late free of charge. In case of unavailability of the service we reserve the right to withdraw from the contract. In such a case, we will of course inform you immediately and refund any consideration already provided without delay. In the event of data failure, we cannot guarantee timely delivery. If you order several articles from us within the framework of one order, for which different delivery times apply, we will send the goods in one joint shipment, unless we have agreed otherwise with you. In this case, the total delivery time for the consignment of goods will be the delivery time that applies to the item in your order with the longest delivery time.

§6 Reservation of title
(1) We reserve title to the goods until the purchase price has been paid in full.

§7 Contract language
(1) The contract language is exclusively German.

§8 Notice according to the Ordinance on Waste Electrical and Electronic Equipment - (ElektroG)

§9 Note on online dispute resolution

Cancellation policy
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

Right of withdrawal
You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took or has taken possession of the goods. In order to exercise your right of withdrawal, you must inform us (Bekabo OHG, An Brenigs Ziegelei 42, Tel: 022829971358, Fax: 022893199084 E-mail address: team@thebeetleshop.com) by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. You may use the attached model revocation form for this purpose, but this is not mandatory. In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.

Consequences of revocation
If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (except for additional charges resulting from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date we receive notification of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this refund. We may refuse to make a refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without delay and in any event within fourteen days at the latest from the date on which you notify us of the cancellation of this agreement. This period shall be deemed to have been observed if you send the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods. You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for testing the condition, properties and functionality of the goods.

Exclusion of the right of revocation
The right of withdrawal does not apply to contracts for the supply of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.
